On December 11, 2025, the President issued an executive order entitled “Ensuring a National Policy Framework for Artificial Intelligence”. The new order builds upon the White House’s July 2025 report “Winning the Race: America’s AI Action Plan” (see our analysis here) and aims to limit the ability of states to enact and enforce their own AI regulation in favor of a unified federal approach. In early December, a new working group was established at the Environmental Protection Agency offering to provide regulatory advisement to companies working through data center permitting issues.
