Squires issued a memorandum adding a new domestic-industry factor to the reasons the Office may decline to institute an inter partes review (“IPR”) or post-grant review (“PGR”).1 This domestic-industry memorandum reflects a broader and ongoing trend within the Office toward favoring patent owners by discretionarily denying petitions more often.
